Vassilkovska had bought a user car from Woodfield Nissan Inc. After sales a dispute came up with Vassilkovska trying to sue Woodfield in court due to misleading terms in the finance agreement they had. His efforts to sue Woodfield in a state court didn’t succeed after they found out that they had an arbitration agreement with Woodfield which means they would solve the case outside the court. As a matter of fact the arbitration agreement was done in favor of Woodfield which means that there was no ground under which Vassilkovska would sue Woodfield but Woodfield would sue Vassilkovska. During the making of the arbitration agreement Wood field can be said to have tricked Vassilkovska so that all unethical since no party would want their issues to be arbitrated while the other party can present the issue in court. Legal Remedies According to Ilinois State Statues Woodfield violated the Consumer Fraud and Deceptive Business Practices Act by misrepresenting the price.. Vassilkovska has the right to sue Woodfield in regard to the actions on intentional torts. Woodfield made her sign the agreement knowing that it had the wrong price indicated on the purchase agreement. This is fraud and the court should order Woodfield to return all the payments to her and she should also return the vehicle. The remaining loan balance should be cancelled. References Burke D.
