AUSTRALIAN CONSUMER PROTECTION LAW Student name /number Subject code /name AUSTRALIAN CONSUMER PROTECTION LAW Manufacturer’s liability The Australian Consumer Law (ACL) and the Competition and Consumer Act (CCA) 2010 are two pieces of legislation that provide the statutory guidelines to the consumers and manufacturers in Australia (Decker 2017). The term manufacturer under the Australian Consumer Law potentially includes all individuals in the supply of the product in question (Nottage 2010). The consumer law is found in the second schedule of the Competition and Consumer Act of 2010. It was modified and took effect on 1st January 2011. The steps to be followed in seeking compensation for injury and damages are prescribed within the different parts of the law. Part 3 through part 5 of the second schedule of CCA 2010 (Decker 2017). The manufacturers are liable to consumers for the following: Goods not corresponding to the specifications Goods of consumers have a right to consumer guarantees. Upon non-compliance by the manufacturers /suppliers the manufacturers are liable to the consumers. This requires that the consumers are compensated for the losses or damages resulting from the purchase and use of defective goods or products. Injuries leading to loss of function such as James’ should be compensated with large sums of money to ensure compliance of such companies with the law and help James take care of his needs after the disabling accident.
