Name Tutor Course Date Liability of Employers for References The duty of care which is a derivation from tort law can be described as a responsibility that is imposed on person or institution which requires them to stick by a certain standard of considerable care. In particular this obligation is usually imposed during acts that can present foreseeable harm and in the court of law it is an essential aspect that should be determined in order to proceed with a negligence action. It is important to note that sometimes the duty of care can be enforced by operation of law for individuals or institutions without a contractual or familial relationship but who ultimately become acquainted in various manners. Accordingly it is then described as common law or rather case law. In this regard this particular law outlines that a duty of care is obliged to anybody who is likely violation. All in all it can be concluded that the common law of duty is highly applicable for employers who offered references to former and current employers. The same also applies to universities that may be required to provide references. In both employers and universities failure to meet conditions may be regarded as a breach or negligence of duty and thus attract penalties.
