Attorney-client privilege seeks to protect confidential information as between the attorney and the client whereas the work product doctrine seeks to protect documents prepared by the attorney for the client in the course of legal representation (Larner and Lacey, 2009). The difference as between the two is to the effect that the work product doctrine does not offer an absolute privilege whereas the attorney-client privilege categorically protects the correspondence as between the attorney and the client and the attorney but not the underlying facts (Larner and Lacey, 2009). As regards the battle between Attorney Michael and the FBI, if it is shown that the Presidents’ Attorney’s offices were raided and the information/ documents prepared in anticipation of a pending suit were breached, then it is clear that the FBI is in clear breach of their ethical duties.
