Furman vs. Georgia Key arguments offered by the majority to abolish the death penalty The arguments offered by the majority to abolish the death penalty were grounded in the discriminatory application of the death penalty. The majority opinion was that cruel and unusual punishment pertains to the selective decision to harshly punish the disenfranchised while giving the other segment of the population preferential treatment. The judges decided that the term “unusual” covers inflicting the death penalty by reason of his race religion ignorant and unprivileged. In rebuttal to this a similar argument can be imposed on the societal angle of the issue as opposed to the legal side. Just as much as people were racist the same applied to the likelihood of convicting those who are not financially endowed to hire good lawyers. The challenge was a socio-economic one and the way people regarded the rich over the poor not the death penalty. This was beyond the scope of the court and it should have remained so.
