The decision went against an earlier decision by Plessy V. Ferguson (1896) that supported segregated public facilities were in line with the constitution as long as such facilities were equal to each other. The action to stage resistance was exacerbated by white school refusal to admit black students. A case in point is where Topeks white schools refused to accept Brown’s son in the facility, leading to the filling of Brown v. Board of Education. Bollinger, the constitutionality of an affirmative action program could only gain traction through individualized evaluation. The Gutter v. Bullinger, on the other hand, held the grounds that the law school conducts highly individualized reviews of all applicants hence no rejection or acceptance was purely based on race; all factor that would contribute to diversity was put into consideration alongside race.
