Despite the adverse effects that these actions bear on the society as a whole, the punishment or the penalty it attracts have remained a concern to date. The major concern is on the legislations, which try these cases as civil entities. Perhaps, this can be termed as the primary motivation, that makes organizations view this as less serious. There should be a reconsideration on such legal issues, categorizing them as criminal, and trying them in criminal cases. Grace corporation was seen to be the first to enter into a settlement, in the name of compensation. This was done to cool the temperatures, without any intention to address the whole issue.

The other extreme is when the judge made the jurors to answer three questions, in order to determine whether the companies were guilty (Harr, 2011). The most fascinating of all, was the fact that these questions were not framed correctly. The questions appeared to be worded incorrectly, in such a way that they were difficult to comprehend. The argument in this is the fact that these questions were meant to help the defense in the hope of not giving room for testimonials from the parents.
