3d. Court Case Citation United States Court of Appeals, Eighth Circuit. Huber v. Wal-Mart Stores, Inc. , Appellant. During the period of asking for a transfer by Ms Huber, the company had an available vacancy that was of her choice at Clarksville distribution center paying equally paying as her original position. Nevertheless, the company did not accept to automatically reassign Ms Huber Router position, she was reassigned another not of her expectation. She is to apply with other applicants and the most qualified candidate will be hired as per the company’s hiring policy. Eventually, Wal-Mart’s hired the most qualified applicant at the expense of Ms Huber’s expectations. In response to this, Ms Huber filed a petition in line with the American Disabilities Act (ADA).
