The Supreme Court decision in Camara v. Municipal Court clarified that even private security guards must comply with the Fourth Amendment while executing their duties (Nasim, 2014). However, the private interests enshrined in the Fourth Amendment can be waivered if there is reasonable course to protect public interests. Public law enforcement departments are mandated to secure a search warrant before embarking on searches and seizures. Unreasonable searches and seizures conducted by the public enforcement agencies are declared unconstitutional within the meaning of the Fourth Amendment. The court had to examine whether the Pinkerton committed the tort of negligence by employing a person who has questionable characters. The court also deliberated on whether the action of the employees could result into a breach pf contract.
