In a union-free environment, employers and the employee enter into an agreement about wages, benefits, and other issues relating to employment. The employer determines the wage rates, work hours, bonus, promotion and makes all decisions in the company. These two environments present an employer with different operating systems. Union Environment The organizational structure of a unionized company is such that not all employees in the company are unionized. The NLRA considers employees such as supervisors and the management level above the line of supervisors not to have a community interest with workers; the NLRA identifies supervisors and above management as employees that act on behalf of the employer. When it comes to salaries and wages, the worker has the right to negotiate with the employer.

However, the employer is not obligated to negotiate or fulfill any of the demands as long as he operates within the labor laws. An employer can constructively dismiss an employee without fear of being sued because he is in charge. The dismissal is rather easy compared to a union environment which would require filling dismissal forms and notifying the union. The employer is not obligated to provide nonunionized workers with a retirement plan. An employer can also provide facts about the law and union membership- fees rules and dues. An employer can also discuss the performance of unionized and nonunionized organizations with regard to salaries, health benefits, pension and safety conditions. Most importantly, an employer must not threaten to harm or dismiss; interrogate employee not to join a union; promise benefits if employees do not organize a union; and conduct unlawful surveillance on his employees (Allen, 2015).
