Concurring Opinion: Justice Kennedy Justice Ginsburg Justice Sotomayor Justice Kagan was not involved in the case The case was filed by the petitioner (Beckles) in the Supreme Court seeking a certiorari for the United States Court of Appeal for the eleventh circuit. Beckles had been convicted under convicted felon 18 U.S.C. §922 (g) (1) for illegal ownership of a shotgun in the district court and the decision was affirmed by the eleventh circuit. The court decision was grounded on a pre-sentence investigation that found the petitioner guilty of being criminal law and thus is vague since it denies the ordinary people a fair notice to the conduct it aims to punish or so standardless that it invites arbitration”. In light of this context this court has invalidated two criminal laws: laws that describe criminal offences and those that define the permissible sentences for criminal offences.In addition the court held that the guidelines do not fix the allowedarray of sentences for a felony. They are just guidelines to the court’s discretion in selecting the best sentence for a given statutory range. The guidelines are therefore not subject to vagueness challenge under the Due Process Act. In this respect the residual clause in §4B1.2 (a) (2) holds and cannot be ruled to be void.
