The Government’s Entrapment of Jacobson Name Institution The Government’s entrapment of Jacobson Summary of the existing facts Jacobson ordered for the Bare Boys magazines before the Child Protection Act of 1984 declared it illegal to receive content through mail of sexually explicit images of children. Following the finding of Jacobson’s name on the mailing list two agencies from the government sought to entice him into purchasing the magazines depicting explicit images of preteen boys through acting as activists lobbying for the respect of individual freedom of sexual expression. The petitioner responded to some of the mails. However after two and a half years he was enticed into purchasing a child pornography magazine. He was consequently arrested after a controlled delivery of a copy of the magazine. When his house was searched only letters the final ruling ("Jacobson v. United States" n.d.). Their combined stand overruled the Court of Appeal’s ruling and proceeded to make a new precedent. Question 5 I do not agree with the commentary that the decision ties the hands of law enforcement officers because they are supposed to respect a citizen’s personal preference and sexual orientations provided he does not violate the law. It was wrong for them to induce the petitioner to violate the law ("Entrapment—Elements" n.d.). They should have consulted the mailing list to check whether he violated the law since it was established which they did not. References Entrapment—Elements. Justice.gov.
