The Substance Abuse Crime Prevention Act or California Proposition 36 permanently changed state laws and allowed all qualifying defendants who are convicted of non-violent drug possession to get their probation sentence instead of their incarceration. For example, if such defendants fail to complete this important program or they violate any other terms and conditions of this law, their probation will be revoked and they’ll be required to serve an extra sentence, including their incarceration.

Who are qualified defendants?
