Censorship Issues in United States

Censorship in the USA involves the suppression of public communication or speech. It raises issues of freedom of speech protected by the First Amendment to the US Constitution.

This freedom has been accompanied since its enshrinement with controversy and contest. For example, restraints increased during periods of anti-communist sentiment, which lead to certain restrictions. It is legal to pronounce hate speech if a person does not engage in the illegal acts or urge other people to do it.

The First Amendment does not protect against corporate censorship, the sanctioning of speech by employees, spokespersons, and business associates by the threat of loss of employment, monetary loss, or loss of access to the marketplace. Lots of people in the USA like the idea of restrictions of corporate censorship.

In 2014, the United States was ranked to be 46th in the world regarding the Press Freedom Index. Certain forms of speech are restricted in large media outlets by the government or by its owners.

John Peter Zenger was involved in a legal case that took place in 1734–1735 because it published material critical of corrupt William Cosby. He had spent eight months in jail before being tried for seditious libel. He was defended by Andrew Hamilton who pronounced a famous speech, stating that nature and the laws of the USA country had given people a right to liberty of both opposing and exposing arbitrary power by writing and speaking truth. This allowed Hamilton to invoke the concept of jury nullification and win the case. The case of Zenger was a starting point for freedom of the press in the US, which was adopted in the constitution.

The United States knows several attempts to forbid speech. President John Adams signed into law the Alien and Sedition Acts in 1798. The law resisted false, scandalous, and malicious writing about the President or Congress. The act expired in 1801.

Currently, the USA has free speech zones. These are known as Free speech cages, First Amendment Zones, and Protest zones. These areas are dedicated for people who wish to use their right of free speech.

The main purpose of free speech zones is to protect the safety of people attending the political gathering. At the same time, some critics believe that these areas are used by authorities in a heavy-handed manner to censor protesters and make them invisible for the mass media. Authorities deny targeting protesters, but ACLU has filed several lawsuits on the issue.
