Defense of Marriage Act

As reported by the Agency of France-Press, the federal law that defines marriage as a union between man and woman, it has been recognized by the US Supreme Court to be unconstitutional. Five judges out of nine voted in support of such a decision. In their opinion, the Defense of Marriage Act creates a limitation of the rights of same-sex couples.

The point under consideration in the US Supreme Court case was as follows: the plaintiff, 83-year-old Eddie Windsor, was forced to pay taxes for property worth more than 600 thousand dollars after the wife's death just because they signed the marriage in Canada that was not recognized in the US.

Edith (Eddie) Windsor from New York was officially married, which was recognized by the authorities of that state, with his partner. When a partner has died, Windsor had to pay federal estate tax, but she was denied benefits that are provided for ordinary couples, as a federal law of 1996 interprets the marriage as "a union between one man and one woman as husband and wife."

The Supreme Court declared the 1996 law was unconstitutional because it contravened the principle of equality before the law. Judge Anthony Kennedy, representing the majority on this issue, said that marriage laws were designed to protect the "identity and dignity" of all human beings, without exception, and that "no goal" could not be higher than this.

Two judges, the Chief Justice John Roberts and Justice Antonin Scalia who are conservative, provided written reasons for his disagreement with the decision of the majority. In connection with the decision of the Supreme Court Eddie Windsor will receive the payment of more than 363 thousand dollars from the treasury of the state because she did not receive the benefit in time.
