Federalism in the United States of America

At first, let’s figure out what federalism is. Federalism is a system of government in which a constitution regulates the power of central government and regional governments. These types of government act directly upon the people through their officials and laws. Indeed, federalism gives power to the central government, but at the same time, it also gives power to the states. Because of this, there were a lot of occasions when the Supreme Court had to decide what federalism means. Both types of government are supreme within their sphere. In the USA the term “federal government” is usually understood like the national government in Washington. However, this is not completely correct. Federalism has evolved throughout American history. So, here are some forms of federalism. Co-operative federalism: It means that two types of government are actually partners. Dual federalism: It means that central government and regional governments act separately. Creative federalism: This form involves planning and making decisions together. Horizontal federalism: This form assumes the use of common programmes for 50 states. Marble-cake federalism: This form assumes intermingling of all levels of government in policies and programming. Vertical federalism: It is a traditional form of federalism. The actions of the national government are supreme within their constitutional sphere. In America, each state has political importance and its own position. A state is not a sovereign body, but it can carry out functions and make decisions that would be made by the central authority in other governmental set-ups. States are limited in such fields as the control of the currency, foreign affairs and defense. In real life, we can see that most of the civil and criminal laws that regulate Americans’ lives are state laws. For instance, traffic law, family law and commercial law. The brightest example of a state’s right to implement laws is the right to decide by itself to have or not to have the death penalty for convicted murderers. However, the states have to observe the Constitution of the United States of America and have to obey laws of the federal government. Sometimes it may be difficult to figure out where one level of government ends and the others begin. So, federalism has many advantages and disadvantages that have been the subject of debate since the creation of the republic.
