GM v. Moseley - the story of a trial

At the end of the 20th century, the story of a trial between General Motors and the Moseley family was very popular. This is very sad story of small people, who could prove their rights to the whole world.

The process of the trial between them started in February 1993. The Moseley family wanted to get from the company 101 million dollars for the death of their 17-year old son, Shannon Moseley. The boy died in a fiery crash in his car, GMC sierra pickup, in 1989. The cause of the car accident was a drunk driver who struck his vehicle on the side. Moseley were trying to prove that their son died because of GM’s fault. They stated that the crash wasn’t the cause of the death, but the fire. GM was trying to prove that it wasn’t their fault at all. The company even offered money compensation to the Moseley family in order to dismiss the case, but they refused.

It was found out that General Motors was aware of the defectiveness of such type of cars, but, for some reason, didn’t fix it. The problem of the design was in a fuel tank that was placed outside a frame. Such disposition makes the tank very vulnerable to punching during a crash. Moreover, General Motors got not only this complain, they received at least 130 another complaints about the design of the fuel tank. Such fuel tank was used for trucks from 1973 to 1987. In 1988, the company hid the tank inside the frame. Yet, GM refused to accept that it was done for more safety.

The main question of the trial was whether Shannon Mosley died right after the stroke or he died when the fire started. The boy’s parents were insisting on the second variant. The main concern of his parents was whether their boy suffered a lot before his death. GM stated that the boy died almost immediately after the crash and he didn’t feel the pain. Yet, the jury relied on the evidence of eyewitness, and the expertise of the Shannon’s body. The witness stated that the boy was screaming for help, which proved the words of the Mosley.

The jury also got the evidence of a former GM safety engineer. He stated that the company knew about the danger that can be caused by such a design, but didn’t want to fix it being afraid of public. Moreover, in the court, there were presented the videotapes of the crash test and they showed that when the truck was hit on the side, its fuel tank broke down.

This story is very sad, but still very inspiring. It is good to know that there are people who were not afraid to fight with such a big company.
