Essay: Gratz v. Bollinger

Once Jenifer Gratz was applied at the University of Michigan and she was denied because of admission. It was admitted that races are used as one of the factors of making admission decisions. Diversity was like a compelling interest, that is why the District Court held the admissions policies which weren’t tailored narrowly for years 1995 – 1998. But these policies were narrowly tailored in 1999 and 2000. After such decisions, one more applicant who was denied by the admission, write the petition and came with it to the Supreme court of United States of America. The man petitioned to the “Rule 11”, which was granted by them.

In addition, in the court two sides were who support the both partners. Among the people who support concurring side were Chief Justice (William H. Rehnquist), Associate Justices (Sandra Day O’Conner, Antonin Scalia, Anthony Kennedy, Clarence Thomas and Stephen G. Breyer). They were also people in the court who support dissent side (Associate Justices – John Paul Stevens, David H. Souter, Ruth Bader Ginsberg).

Is it really noticed that the University of Michigan uses the racial preferences? Is it really important while under graduating the admissions violate for the Equal Protection Clause of the Fourteenth Amendment or Title VI of the Civil Rights Act of 1964?

Unfortunately, the answer is positive. According to the judicial results, the court proves that the head of the Universities really use the different racial preferences for the undergraduate admission. And this policy was violated the Equal Protection Clause and Title VI.

Steven, who was the justice in this case, commented this situation. He said that all the petitioners were reapplied to the other universities where students are applied according to their knowledge level and got estimates, but not to the racial preferences. It also was said that petitioners would not get any benefits from this story, just legal and proper right of being applied to the desirable university to get the master’s degree. One more justice, whose name is Souter, also gave his agreement and was agreed with the chief justice while discussing this unusual situation. He added that it was the obvious violating of the rules and right, when the heads of universities chosen the students because of their nationalities. It was the rude mistake, but thanks to this case, such problem becomes the actual one, and the justices hope that no one will try to repeat it.
