The Articles of the Confederation

In June 1776 the first Continental Congress appointed a committee to prepare the Articles of Confederation, which entered into force on 1 March 1781 only.

Articles of Confederation consolidated and made it legal, as stated in the preamble, the creation of a permanent States Union. In Article II it was mentioned that each state safes its independence, freedom and sovereignty, and jurisdiction any power, and right, except that exactly the Confederation takes to the United States gathered in the Congress." The name of the confederation, said in the article I, is "United States of America". There were 13 independent countries or states. Confederate Union set itself above all foreign policy objectives. In the prevailing conditions this was a war of independence against Britain.

United States Confederation was not a state in the proper sense of the word. It is not a federal state, but a union of independent states. Therefore, Articles of Confederation represent some kind of an international treaty, rather than the fundamental law of a single state. Although confederative union of sovereign states and the US was not a state in the strict sense, but within it some of the economic, political and psychological foundations of the American statehood were laid, the legal basis of which was the Constitution of 1787

Articles of Confederation did not establish a single citizenship. In Article IV refers to the independent inhabitants of each of these states," the "free citizens in the various states," rather than citizens of the Union.

Congress was established by the Articles of Confederation. It was composed of the delegates appointed by the states each year in the manner prescribed by them. The delegates could be recalled at any time and replaced by others. Each state in the Congress had a single voice. If the delegation could not find the common point, they lost the right to vote. The Congress was a "meeting of diplomats," and delegates were not deputies, but "diplomatic agents".

Congress formally possessed by all foreign powers. It could declare war and make peace, also it sent the appointed ambassadors, concluded treaties, and managed trade with Indian tribes. In the domestic sphere of its powers it has been rather modest. It suffices to say that he had no right to tax and thus was deprived of its own financial base.

Congress, after the victorious conclusion of the War of Independence, took Northwest Ordinances, which created a legal basis for US territorial expansion.
