The Issue of Flag Desecration

Flag desecration is a deliberate destruction or damage to the flag. Desecration of the state flag can have a protest character, since it is associated with abusive behavior towards national symbols or symbols of power, or committed by hooligan motives.

In some countries, the desecration of flag is a crime. For example, in Russia desecration of the state flag is criminally punishable, but desecration of flags of other countries it is not punishable. There are no special instructions about the use of the national flag for the citizens of Denmark, Norway, and Sweden. These countries are fully entitled to a variety of ways to mock their national flags, however, desecration of foreign flags is prohibited.

The laws of England, Scotland, and Wales have no description of the penalties for flag desecration, but there is such liability in Northern Ireland since its detachment in 1921, which was subsequently modified several times. In Northern Ireland, during the protests people often burn the Union Jack and the Irish tricolor.

In the US, flag desecration was banned for a long time. For example, in New Orleans William Mumford was hung for the destruction of the flag, and much later a media mogul Larry Flynt was accuses in the improper use of the flag. The ban on public burning of the flag was canceled by the decision in the case Texas vs. Johnson in 1989.

US Republican Party has repeatedly demanded to prohibit the desecration of the flag again, but its opponents appealed to the First Amendment, so that the burning of the stars and stripes remains an attribute of many rallies and demonstrations.

Along with the burning for abuse, there is a ceremony of burning flags with rendering of honors and stipulated rules as the preferred method of disposal in the United States.

In 1970, Dean Reed publicly washed his country’s flag in front of the US consulate in Santiago to protest against the Vietnam War and the US policy in the countries of the so-called Third World (including Latin America).

In China, there is a three-year sentence for abuse of state symbols, which was introduced in 1990, shortly after the events in Tiananmen Square. It is noteworthy that such measures were not meant to tighten, but on the contrary, to humanize the punishment.

In February 2013, in Hong Kong a political activist was sentenced to nine months in prison for burning the Chinese flag. There are stringent penalties for such conduct in the administrative region – up to three years in prison or a fine of up to 50 million Hong Kong dollars ($7,000).
