The Racial Profiling Concepts

The concept of racial profiling is generally understood as the use of membership to a particular human race or ethnicity by law enforcement officials as a key factor in making a decision in relation to stop, arrest, or interrogate a person if his or her race or ethnicity is a part of the description of specific suspects in a certain crime.

There are many different concepts of racial profiling, and at least two approaches to understanding it: narrow and broad.

The understanding of racial profiling in a narrow sense includes only the activities of law enforcement agencies for questioning, interrogations, arrests and/or finding someone guided by racial or ethnic origin of a person.

The understanding of racial profiling in a broad sense involves the use of race and ethnicity as an additional factor, along with a set of other factors, as a basis for the response and taking action.

There is no common approach to the assessment of racial profiling as a way to prevent the commission of crimes, as well as there is no a comprehensive scientific study of it (for a more thorough and effective investigation of criminal cases).

Critics of racial profiling acknowledge that the law enforcement authorities have broad powers when it comes to things like stopping and searching people, which became the cause of many lawsuits.

The issue of profiling was raised at the conference of the Durban process and recorded in the final documents of the conference. According to the Durban Declaration, racial profiling is defined as the practice of police and other law enforcement agencies, which is used to a greater or lesser degree in race, color, descent, or national or ethnic origin as the basis for subjecting people to investigatory or other actions or to determine whether the person has taken part in establishing criminal activity.

Racial profiling opponents argue that the tendency to commit crimes and the growth of the crime as a whole cannot be imposed on members of a particular race or ethnic origin, especially since the discriminatory actions of this kind affect the public confidence in law enforcement agencies, especially among representatives of one or another race or ethnicity, which in itself undermines stability in society.

Representatives of many law enforcement agencies have noted that, despite the controversy surrounding this approach, the use of racial/ethnic profiling is an effective and necessary in connection with any real socio-demographic factors. Ignoring these facts is even more immoral and unprofessional. Many experts note the use such factors as race or ethnicity does not necessarily lead to any harm or discrimination.
