Employment Wages Act

The Employment Wages Act determines the legal wage organization of persons working under a labor contract, providing them with guarantees and compensation payments related to salaries.

Wage is the remuneration paid by the employer to the employee for work done by him or her under the labor contract or legal act, as well as in other cases stipulated by law or labor agreement.

There are several kinds of wage:

  • Basic wage is salary, determined by labor contract or legal act based on an hourly, daily, weekly or monthly rate of pay.
  • Additional is the amount paid by the employer to the employee in addition to the basic salary for the performance of additional work tasks or the work of increased efficiency or in other cases stipulated by legal act, labor agreement, as well as premiums on the basis of one-sided decision of the employer.
  • Extra wage is the amount paid to the employee for the provision of full wage and compensation in case of possible reduction of the amount of wage.
  • Average wage is calculated from the total wage for a certain period at a certain unit of time.
  • Minimum wage rate is the amount established by the Government corresponding to a specific unit of time (hour, day, week, month, etc.), below which an agreement for full-time work cannot be concluded.

The rate of the employee’s salary is set at the conclusion of the employment contract by mutual agreement.

Changes in the conditions of payment stipulated in the employment contract are allowed to be made only by agreement of the parties.

The employer sets the wage rates in accordance with the difference between the work and working conditions, based on the agreement between the employer and workers of the agreement.

The wage rate is changed by agreement of the parties, as well as in case of changes in the minimum wage rate established by the Government or a collective agreement.

According to the Employment Wages Act, the period of calculation and terms of payment of wages are established by the labor contract, internal regulations or collective agreement, but the wages are paid not less than once a month. The salary is paid to the employee at the workplace and during working hours, except for the case.

The salary is calculated for completed and accepted by the employer work for the entire payroll period.

The employer is obliged to pay on the day of termination of the employment contract to the employee all amounts owed by the employer. If the worker could not accept payment on the day of termination of the employment contract, the employer must pay the payment within five days from the day following the submission of the request.
