The Importance of Equality to All People

There is an opinion that all men are created equal, but when it comes to the Constitution, it’s not stated anywhere. Its 14th amendment ensures the equal protection of laws, and the concept of equality is central to modern ideology so that people often forget that it doesn’t appear in the Constitution. This statement is in the Declaration of Independence, and it’s a document that has no real legal power. It was made to declare the separation from the UK and it offers a set of important ideas.

The closest thing to equality to all people that can be found in the Constitution is in the 14th amendment. Pay attention to the clause that states that no state can deny people’s equal protection of laws. This means that they all are provided with the equal treatment under existing laws. The main problem is that this amendment doesn’t provide the federal government with enough power to stop discrimination and its private acts.

It’s obvious that the ability of the federal government to advance equality to all people is restricted by this fundamental requirement so that it can just take action to guarantee the states don’t apply their policies or laws in any discriminatory manner. Besides, this amendment doesn’t provide the federal government with enough power to intervene in all kinds of private matters.

However, equal protection of all people under existing laws doesn’t require the government to treat them exactly the same. That’s because laws can draw specific legal distinctions between their different groups. Under the 14th amendment, the federal government can ensure that all employers and agents will treat people equally and extend its rigorous protection. In its limited sense, this kind of equal protection clause really protects all people.

You should understand that equal protection doesn’t mean that everyone has to be treated exactly the same. For example, a teenager can’t be provided with the same right to drink alcoholic beverages as adults. It’s no wonder that the concept of equal protection is associated with a lot of critique. Some people think that there is ironic inequality in the way how it’s applied, while others accept the need for diverse tests for different classifications. Finally, when it comes to advocates for older and poor people, they argue that laws should receive a better review, while many gay rights advocates claim that they want to see the laws impacting their clients to receive a better view.
