The Patriot Act Does Not Violate Constitutional Rights

Patriot Act is a law that gives the US intelligence agencies carte blanche to spy on the private lives of Americans under the pretext of protecting them from terrorism.

Patriot Act was introduced immediately after the September 11, 2001, and has not only legalized wiretapping, revision of mails and e-mails, as well as surveillance, but also such sophisticated forms of invasion of privacy, as the secret seizure of business documents and medical histories. In addition the security services were given the right to get acquainted with the library forms in order to ascertain whether Americans read anything seditious.

Along the way, the United States have established a military commission, essentially military tribunals composed of three members for the examination of cases of foreign nationals suspected in terrorism. The status of these bodies did not provide a clear presumption of innocence, nor did it require unanimity to send a man in Guantanamo military base.

Immediately after the terrorist attacks on September 11 these measures seemed more or less acceptable. But many years later, liberal America is outraged with aggressive position of the executive branch. Human rights groups, congressmen and senators, the media and even the courts have concluded that the president had usurped the rights that were not vested by the constitution, and encroached on the freedom of the individual. George W. Bush sought for the law to remain in force as long as possible, because it provided the authorities and security forces with the necessary tools to combat terrorism.

The validity of Patriot Act signed by George W. Bush was to expire on December, 31, 2005, but then Bush appealed to lawmakers to extend the document. The White House issued a statement urging senators to support the president’s initiative.

The Bush Administration, in particular, required making permanent such existing provisions as the right to wiretapping and tracking of correspondence over electronic networks of people suspected of involvement in terrorism. Opponents of the law required to make at least 30 amendments in the Act that would guarantee the protection of the rights and freedoms of Americans.

In 2011, Obama signed a four-year extension to the Act of three main provisions: searches of business records, roving wiretaps, and surveillance of people suspected in terrorist activities. Parts of the Act expired in 2015, but the next day these parts were restored and renewed through 2019. The section on collection of phone data was amended.
