Casey Martin versus the PGA Tour

Casey Martin is a golfer who wanted to become a professional. Casey is suffering Kippel-Trenaunay-Webber syndrome, a congenital circulatory disorder that gives rise to a bad swelling in his right leg and foot making it almost impossible to walk.

PGA is a non-profit organization of professional golfers. It is a sponsor of three competitive tours: the PGA Tour, the Nike Tour, and the Senior PGA Tour. The main ways of getting entry to the PGA Tour and the Nike Tour is by competing in the qualifying school. The best scores of this competition get to enter the PGA Tour, while the next best get an access to the Nike Tour. Players of the Nike Tour can get in to the PGA Tour by winning three Nike tournaments in one year or by being in the top fifteen money-winners of the Tour.

The competition of the qualifying school is held in three stages. In the first stage, golfers can use golf carts. In the second stage, and in the third stage, as well as in the PGA and Nike Tours, golfers need to walk as they play. After qualifying for the third and the final stage in 1977, Casey asked from PGA to use a golf cart. PGA denied and Casey sued them.

When Casey was 25, he wanted to use a cart to ride from shot to shot on the field, but the PGA had very strict rules and didn’t allow doing that. According to the PGA, golfers can use carts on the Senior Tour, but not during the regular tours and the minor league Nike Tour. At qualifying school the PGA does allow using carts. Casey then went to court, citing the Americans with Disabilities Act. If Casey, a handicapped professional golfer, got an advantage over his competitors by using a cart then the PGA would have been right in not letting him applying a cart. However, if he didn’t get an advantage, the American with Disabilities Act would require the PGA Tour to allow him using a cart to surmount the pain from a disorder that prevents him from walking in the golf field.

Casey still experiences some obstacles. Professional golf is still a hard labor under the best circumstances, and it is not understandable yet whether Casey’s bad condition will let to stay on the Tour even with the help of a cart. Officials of the PGA Tour claim that an outside organization or a company can’t interfere with tournament golf. They also state it is a technical question. Walking is an essential part in golf, and endurance is a prerogative for success. Casey and his lawyers argue that according to the American with Disabilities Act, the PGA Tour has to provide equal access for the disabled. Despite the fact that a court ruled in favor of Casey, outside players think that if you can’t hit a ball in golf, you shouldn’t be allowed to be on a golf court no matter what your condition is.
